Welcome to My Swing Studio. These Terms and Conditions (“Terms”) govern your access and use of the indoor golf training facility and services provided by My Swing Studio (“we,” “us,” or “our”) by all visitors, including Members, Non-Members, and Personal Trainers or Golf Coaches. By accessing our facility or using our services, you agree to be bound by these Terms.
1. Membership and Billing
All memberships and billing cycles are managed through our third-party providers, Chargebee & Stripe. Pay as you go fees (practice range cards, single lessons, club fittings, etc) are managed through our POS system, Square, and will be charged accordingly.
Subscription Plans: By signing up for a membership, you authorize us to charge your designated payment method for the recurring monthly or annual fee.
Recurring Billing and Payment Authorization: Membership dues are billed automatically on the 1st day of each calendar month. Member authorizes My Swing Studio (“Studio”) to charge the payment method on file on the 1st of each month. If enrollment occurs mid-month, the first payment may be prorated. All future payments will occur on the 1st. Members are responsible for maintaining valid payment information. If payment fails, access to booking privileges may be suspended and outstanding balances remain due and payable.
Failed Payments: In the event of a failed payment, access to the facility will be suspended until the balance is resolved.
No Rollovers: Unused sessions, hours, or benefits do not roll over to future months and expire at the end of each billing cycle. Membership pricing reflects monthly access and consistent usage.
Freeze Policy: Members are permitted one (1) freeze per 12-month period for a maximum of 30 consecutive days. Freeze requests must be submitted in writing prior to the requested freeze start date and before the upcoming billing date. Freezes may not be applied retroactively. At the conclusion of the freeze period, billing will automatically resume on the next scheduled billing date. Additional freezes are not permitted except where required by applicable law (such as military deployment or documented medical incapacity). This limited freeze policy is provided as a courtesy and may not be combined or extended.
Cancellation Policy – 30 Days’ Written Notice Required: To cancel a membership, Member must submit written notice via email to the Studio at least 30 days prior to the next billing date (the 1st of the month). Billing will continue during the 30-day notice period. Verbal notice is not valid. Members may cancel using the same method used to enroll or by written request to the Studio.
2. Facility Access and Security Cameras
For the safety of our members and the protection of our high-value equipment, My Swing Studio utilizes 24/7 video surveillance.
Surveillance Notice: By entering the premises, you acknowledge and consent to being recorded by security cameras located throughout the facility.
Security Use: Footage may be reviewed for security purposes, to investigate damage to equipment, or to verify compliance with facility rules.
3. Simulator Usage Rules
To maintain the quality of the experience for everyone, all users must adhere to the following rules:
Equipment Care: Please treat all simulator equipment, including cameras, projectors, touch screens, sensors, and automated teeing devices with care. Do not touch the impact screens.
Approved Balls and Clubs: Only golf balls provided by My Swing Studio may be used. Clubs must be clean and free of dirt or debris to avoid damaging the screens.
Footwear: Clean athletic shoes are required. No metal spikes or muddy outdoor shoes are permitted on the hitting mats.
My Swing Studio Equipment Damage: Any damage caused to simulator equipment, screens, sensors, or facility property will be charged to the user responsible.
User Equipment Damage: Any damage to a user’s personal golf equipment is the sole responsibility of the user.
Swing Clubs in Bays ONLY: Only swing your clubs inside the assigned bays—never in common areas. If you’re sharing a bay, anyone not swinging must stand completely clear of the person taking a shot.
4. Liability Waiver for Physical Activity
The use of golf simulators involves physical exertion and the use of golf clubs and balls at high speeds, which carry inherent risks.
Assumption of Risk: You acknowledge that your participation is voluntary and that you assume all risks associated with the use of the facility, including but not limited to the risk of injury from falls, overexertion, muscle strain, equipment failure, ricocheting balls, or even permanent disability and death.
Health Representation: You represent that you are in good physical condition and have no medical impairments that would prevent safe participation.
Consent to Medical Treatment: You consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during your session and agree to bear all costs associated with such treatment.
Capacity to Sign: You represent and warrant that you are at least 18 years of age and are otherwise legally competent to sign this agreement, or that you are the parent or legal guardian of the minor user and have the legal authority to sign on their behalf.
Waiver and Release: You agree to release, waive, and forever discharge My Swing Studio and its staff from any and all claims, demands, or causes of action for personal injury or property damage, including those claims arising from the Studio’s own negligence.
Acknowledgement: By signing, you acknowledge that you have read this waiver, fully understand its terms, and understand that you are giving up substantial legal rights. This waiver shall remain in effect and apply to all subsequent visits to My Swing Studio.
4.1 Minors and Guardians
If the user is under 18 years of age (a “Minor”), a parent or legal guardian must sign these Terms and the Liability Waiver on the Minor’s behalf. The parent or legal guardian assumes full responsibility and liability for the Minor’s use of the facility and compliance with these Terms. Minors may only access the facility while under the direct supervision of an adult or an authorized My Swing Studio coach. Children 12 years old and younger require direct adult supervision at all times.
5. Intellectual Property
All content, logos, software interfaces, and branding associated with My Swing Studio are the exclusive property of My Swing Studio or its licensors.
Limited License: You are granted a non-exclusive, non-transferable right to access the software provided within the simulators for the duration of your session.
Prohibitions: You may not copy, modify, distribute, or reverse-engineer any technology or branding found within the facility.
6. Studio Operational Rights and Conduct
The Studio reserves the right to modify operating hours, adjust scheduling policies, change membership plans (with notice), and suspend or terminate membership for misconduct or policy violations. Members must adhere to booking and cancellation policies for reserved sessions.
